AE Mobile Inc. ("AE Mobile," "we," "us," or "our") designs, develops, and maintains the interactive application Offline Games - Relaxing & Fun ("Offline Games" or the "App"). These Terms of Service ("Terms") are a legally binding agreement that governs your relationship with AE Mobile and your access to and use of our games, features, and related services (collectively, the "Service").
BY ACCESSING, OR USING THE SERVICE IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE OUR SERVICE.
We reserve the right, in our sole discretion, to revise or modify these Terms at any time. Any such changes will be effective immediately upon posting. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
All content made available through the App, including but not limited to text, information, data, images, graphics, audio, video, animations, software, source code, and the overall design, compilation, and arrangement of such content (collectively, the "Content"), is owned by or licensed to AE Mobile Inc. or its affiliates, unless otherwise stated. All rights not expressly granted are reserved.
Except as expressly permitted by these Terms or applicable law, you may not copy, modify, reproduce, republish, upload, post, transmit, distribute, store, display, perform, or otherwise exploit any part of the Content for commercial or non-commercial purposes without the prior written consent of AE Mobile Inc.
All trademarks, logos, service marks, and brand elements displayed in or through the App are the property of AE Mobile Inc. or their respective owners. Nothing in the App or these Terms grants you any right or license to use such trademarks without prior written authorization from the relevant rights holder.
Payment Processing: All in-app purchases and subscription payments are processed by third-party platforms, including Apple Inc. and Google LLC (the "App Stores"). Any payments you make through the App are subject to the applicable App Store's terms, conditions, and policies. By making a purchase or continuing to use paid features of the App, you acknowledge and agree that payment transactions are handled by the App Stores, and AE Mobile Inc. does not control or process such payments directly.
We aim to provide a stable and enjoyable experience, but the App may not always operate without interruption or error. Access to the App can be affected by maintenance, updates, technical failures, or other operational reasons, and availability is not guaranteed. We may update, modify, limit, or discontinue any aspect of the App, including features, content, or functionality, at any time, with or without notice.
The App may include content, services, or links provided by third parties, such as advertisements or external games. We do not control such third-party content and are not responsible for its accuracy, availability, or conduct.
To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis. We make no warranties or representations regarding the reliability, performance, or suitability of the App or any content made available through it, including content provided by other users, third parties, or advertisers. Your experience with the App may differ from that of other users, as features or promotions may vary.
We shall not be liable for losses or damages arising from your use of, or inability to use, the App, including but not limited to service interruptions, loss of connectivity, data loss, device damage, or losses caused by other users or events beyond our reasonable control (such as natural disasters, labor disputes, or technical failures). Indirect or consequential losses, including loss of revenue, profits, or opportunities, are excluded to the extent permitted by law.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or for fraud, where such limitation is not permitted by applicable law.
We take reasonable steps to reduce the risk of viruses or harmful components; however, we cannot guarantee that the App will be free from such threats. You are responsible for maintaining appropriate security and antivirus protections on your device.
For the purposes of these Terms, a "User" refers to any individual who accesses or uses the App. Users are responsible for maintaining appropriate security when using the App, including protecting their devices, local data, and internet connections. You are responsible for how the App is accessed and used on your device, whether online or offline.
Any content generated, displayed, or shared through the App, including messages, gameplay-related content, or other user-generated material (if applicable), is the sole responsibility of the User involved. Users must not use the App to create, display, or share content that is unlawful, defamatory, abusive, offensive, or otherwise inappropriate.
a.If you encounter any content within the App that you believe to be illegal, offensive, or otherwise inappropriate, you should report it to AE Mobile Inc. without undue delay. b.Users are expected to exercise their own judgment when relying on information or content made available through the App. AE Mobile Inc. does not guarantee that all content is complete, accurate, or up to date at all times. c.Users must not use the App in any manner intended to interfere with, bypass, exploit, or undermine AE Mobile Inc.'s services, operations, or business relationships. d.Users may not promote, advertise, or distribute third-party products, services, or opportunities through the App without prior written authorization.
By using the App, you agree to comply with our Privacy Policy, which forms part of these Terms. Failure to comply with these responsibilities may result in restriction, suspension, or termination of access to the App or related services, where applicable.
The App is intended for a general audience and is not specifically directed at children under the age of 16. We do not knowingly collect, use, or share personal information from children under 16. You must be at least 16 years of age to use the App. If you are under the age of 18, or under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the App. If a parent or guardian believes that a child has provided personal information to us without appropriate consent, they may contact us at [email protected], and we will take reasonable steps to promptly address the matter and delete such information in accordance with applicable law.
You agree not to engage in any of the following prohibited activities:
· Violating any applicable law or regulation.
· Using cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Service.
· Harassing, abusing, or harming other users.
· Impersonating another person or entity.
· Interfering with or disrupting the integrity or performance of the Service.
· Infringing upon the intellectual property or other rights of AE Mobile or any third party.
From time to time, we may offer limited-time promotions, contests, sweepstakes, or special offers (collectively, "Promotions"). Each Promotion may have additional rules which will be posted or made available to you. We are not obligated to provide, and you are not obligated to accept, any offer. Offers are non-transferable and non-exchangeable unless otherwise stated. You are responsible for any taxes or fees associated with a Promotion.
The Service may display advertisements from us or third parties and may contain links to third-party websites or services. We do not endorse, control, or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services. Your interactions with these third parties are solely between you and the third party. You access third-party links at your own risk.
8.1 Disclaimer.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, AE Mobile Inc. makes no representations or warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free from harmful components.
8.2 Limitation of Liability.
To the maximum extent permitted by law, AE Mobile Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or other intangible losses, arising out of or in connection with your access to or use of the Service, even if we have been advised of the possibility of such damages.
AE Mobile Inc. shall not be liable for any loss or damage that was not reasonably foreseeable at the time you began using the Service, or that results from your failure to comply with these Terms, misuse of the Service, or actions beyond our reasonable control.
To the extent permitted by law, our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the total amount you have paid to AE Mobile Inc. for the Service in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
